Are You The Best DUI Lawyer?

Are You The Best DUI Lawyer? Someone called my office the other day and demanded an answer. "I want the best DUI lawyer, Is that you?" Believe it or not, I have encountered this question a few times. I always answer by saying, "I have experience, credentials and a great track record, but you should sit down with me and see if I'm right for you."  The truth is that you have to choose an attorney who is qualified.  Once they pass that test, you have to judge them on a more intuitive level. Do you like them? Has their staff...

What Happens At A DUI Pre-Trial?

What Happens At A DUI Pre-Trial? We are often asked questions about what happens at a DUI pre-trial.  The following video explains what you will likely encounter. Our goal at the pre-trial hearing is to have the prosecutor look at the case from the perspective of the accused. We do this by focusing on the decision-making process of the arresting officer and what else could have been done to reach the conclusion that a person was impaired.  The pre-trial represents the best opportunity to resolve the case prior to trial.  In fact, the biggest decision most people will face in their OVI...

I Oppose OVI Checkpoints – Text “DaytonDUI” To 313131

Why do I oppose OVI checkpoints? I oppose OVI checkpoints because they are wrong! When I was a kid growing up in the Miami Valley, we believed that what separated us from the evil Soviet Union was our freedom.  It was a Cold-War trope that in America you need not fear officers of the state stopping you for no reason to ask for your papers. Americans travel freely!  It was at the end of the Cold-War that America began its decades long War on Drugs.  The War on Drugs fundamentally changed who we are. We started to fear each other. We no...

No Sobriety Checkpoints In Columbus

In a rare and unexpected move, there will be No Sobriety checkpoints in Columbus. There will be no grant-funded drunk driving checkpoints in Columbus. The Columbus Division of Police has declined to accept grant funds.  According to the Columbus Dispatch, Sgt. Michael Smith told law enforcement partners, "By order of Chief Jacobs, grant funding has been declined to fund future sobriety checkpoints operations." In addition, "It is with great disappointment that I report to you that Columbus Division of Police no longer has a formal OVI task force." This means that Columbus will rely upon traditional policing to target impaired drivers instead of...

Beer Law: Nothing Is Certain But Beer And Taxes

Beer Law Update! According to the industry advocacy group Beer Institute, on average, more than 40 percent of what Americas pay goes toward federal, state and local taxes. You pay excise to consumption to sales taxes, as well as the normal business taxes. That makes taxes the most expensive ingredient. In addition, the U.S. beer industry contributes nearly $253 billion to our economy. Beer supports 1.75 million American jobs. The Craft Beverage Modernization and Tax Reform Act of 2015 (H.R. 2903/S. 1562) was introduced in the 114th Congress. It is sponsored by Senators Ron Wyden (D-OR) and Roy Blunt (R-MO) and Representatives...
