DUI Checkpoints – Why They Exist

DUI Checkpoints & The Supreme CourtDUI checkpoints, have been upheld by the United States Supreme Court. In the 1990 case of Michigan v. Sitz, 496 U.S. 444 (1990), the court reviewed a checkpoint scheme to detect drunk drivers. Michigan demonstrated that its checkpoint program was minimally intrusive. In addition, they relied heavily upon the fact that Michigan established and operated the DUI checkpoints pursuant to specific procedural safeguards. The Court relied heavily upon a decision of the California Supreme Court, Ingersoll v. Palmer, 742 P.2d 1299 (1987).  Like Sitz, the Ingersoll case placed strict procedural guidelines on the government.Sign up...

I Oppose OVI Checkpoints – Text “DaytonDUI” To 313131

Why do I oppose OVI checkpoints? Watch the video to learn why Charles Rowland opposes OVI Checkpoints. I oppose OVI checkpoints because they are wrong! When I was a kid growing up in the Miami Valley, we believed that what separated us from the evil Soviet Union was our freedom.  It was a Cold-War trope that in America you need not fear officers of the state stopping you for no reason to ask for your papers. Americans travel freely!  It was at the end of the Cold-War that America began its decades long War on Drugs.  The War on Drugs fundamentally changed...

Beavercreek OVI Checkpoint Perfectly Challenged!

There were some visitors at last night's Beavercreek OVI checkpoint.  If you were driving near Wright State University last night, the Ohio State Highway Patrol in conjunction with many other law enforcement agencies were randomly stopping cars and searching Americans without probable cause.  This unwarranted show of force was sanctioned by the fact that the officers were deterring drunk drivers.  Many of us have been fighting OVI checkpoints for years, but recently a new phenomenon has taken place. Some very brave, very committed and very American people have been showing up at these checkpoints holding signs and telling people of the government...

OVI Checkpoints Miss The Point Says ABI

The American Beverage Institute is an industry-sponsored advocacy group that has stood up to Mother Against Drunk Drivers and their campaing for government funded OVI checkpoints. The beverage group says that the National Highway Traffic Safety Administration and Mothers Against Drunk Driving (MADD) should back off from the roadblocks and instead support roving patrols to catch heavy drinkers. "By promoting sobriety checkpoints, MADD and NHTSA are ignoring the root cause of today's drunk driving problem - hard core alcohol abusers,'' ABI managing director Sarah Longwell said in a statement."Because they are highly visible by design and publicized in advance, roadblocks...
