NO REFUSAL Checkpoint tonight in Dayton (Dec. 9th)

Dayton will be holding a "NO REFUSAL" sobriety checkpoint tonight from 9pm until 2am.  The checkpoint will be at North Main and Hillcrest.  Judges will be standing by to issue warrants for forced blood draws should a person choose to refuse a breath test.  This is manipulative, coercive and un-American.  The checkpoint is being conducted by multiple agencies and is being coordinated by the Montgomery County DUI Task Force.  Be smart. UPDATE:  OVI Checkpoint In Springfield Today An OVI checkpoint will be manned by the Ohio State Highway Patrol and other law enforcement officers on Wednesday from 8:30 p.m. until 12 midnight in downtown Springfield along U.S. 40 in front of the new hospital building.  Assisting in the checkpoint will be the Springfield Police Division, Clark County Sheriff Deputies, the Enon Police and medical personnel.  We had previously reported that a second checkpoint was operating in the afternoon in Springfield, but this report was wrong. DUI Patrols Increased For Thanksgiving in Clark and Montgomery Counties

OVI Checkpoints In Clark and Montgomery County Slated for the Wednesday Before Thanksgiving A grant from the National Highway Traffic Safety Administration will allow law enforcement agencies in Clark, Butler and Montgomery Counties to increase DUI/OVI patrols over the Thanksgiving holiday weekend.  The Springfield Police Division and the Clark County Sheriff’s Office will use 48 overtime hours through Sunday targeting drivers under the influence.  The Butler County Sheriff’s Office will increase patrols by up to 150 overtime hours during the same time frame.  Carlene Maynes, coordinator of the Montgomery County OVI Task Force, said 18 agencies, including the Dayton Police Department,...

Thanksgiving To Bring Increased Patrols Along U.S. 33 The Marysville Post of the Ohio State Highway Patrol has announced a law enforcement initiative that will have more troopers patrolling along the U.S. 33 corridor.  Beginning Wednesday and running through Sunday, Troopers and other law enforcement will perform traffic stops along U.S. 33 with the goal of reducing crashes, deterring criminal activity and increasing use of seat belts throughout the corridor.  Troopers will focus on apprehending impaired drivers, detecting criminal activity, seat belt compliance, distracted drivers and commercial vehicle violations.  According to the Post, increased vigilance is necessary due to increased drug...

DUI Checkpoints: Are They Justified (Still)?

U.S. Supreme Court Upholds Sobriety Checkpoints, Michigan v. Sitz, 496 U.S. 444 (1990) In 1986, the Michigan State Police Department created a sobriety checkpoint program aimed at reducing drunk driving within the state. The program included guidelines governing the location of roadblocks and the amount of publicity to be given to the operation. Before the first roadblock went into effect, Rick Sitz, a licensed Michigan driver, challenged the checkpoints and sought declaratory and injunctive relief.
