Marked Lanes Violations & Traffic Stops

When can a police officer make a stop for a marked lanes violation? In State v. Houck, 2011-Ohio-6359, Ohio's Fifth Appellate District considered the legal standards required to stop a person for a marked lanes violation. See O.R.C. 4511.33 “In Ohio, when a driver commits only a de minimis marked-lanes violation, there must be some other evidence to suggest impairment before an officer is justified in stopping the vehicle. Miami Township OVI Checkpoint (August 23, 2013)

If you live in Miami Township, be prepared for a Miami Township OVI checkpoint.  The Montgomery County OVI Task Force announced today that a Miami Township OVI checkpoint will be held in the area of Ohio 741 (Springboro Pike) between Alex Bell and Ohio 725 (Miamisburg-Centerville Rd.) beginning at 7 p.m.  In addition to the Miami Township OVI checkpoint, the Clark County OVI Task Force has announced that they will be conducting over 1000 hours of aggressive saturation patrols in and around Springfield, Ohio throughout the Labor Day holiday. Intoxilyzer 8000 Is Unreliable Judge Finds

A judge recently ruled the Intoxilyzer 8000 (Ohio's newest breath testing machine) unreliable.  In State of Ohio v Chelsea Lancaster, Judge Teresa Liston who heard several cases, combined for purposes of challenging the device, at the request of Marietta Municipal Court Judge Janet Dyar Welch was assigned to hear just these Intoxilyzer 8000 cases.  Judge Liston is a retired judge who serves on the faculty of the National and Ohio Judicial Colleges and Capital University Law School.  She is well known and highly respected by her colleagues throughout the state. Marked Lane Violation Overturned By Third District Court of Appeals

State v. Shaffer, 2013-Ohio-3581 Overturns Marked Lane ViolationIn a decision that will impact many OVI cases, the Third District Court of Appeals ruled that a trooper did not have a “reasonable, articulable” suspicion to stop a Paulding County woman for a marked lanes violation. O.R.C. 4511.33.   Accordingly, her convictions for reckless operation and failure to drive within the marked lanes were reversed.In the court’s unanimous decision, authored by Judge Stephen R. Ohio DUI Crackdown Begins Friday

The Ohio State Highway Patrol has announced that their "Drive Sober or Get Pulled Over" Ohio DUI crackdown will begin Friday, August 16 and last through Labor Day.  During the enforcement period, Ohio DUI law enforcement partners have planned more than 7,000 enforcement hours and more than 900 hours of DUI saturation patrols around Ohio. “Law enforcement partners across the state will be out in full force to ensure people are making the right decisions on our roads,” said Ohio Department of Public Safety Director John Born. “Impaired driving is a serious matter, and the message is clear – drive sober or...
