Ohio OVI Law: What is an Arraignment?

The first hearing in an Ohio DUI case is the arraignment.  Ohio arraignments are governed by Rule 8 of the Ohio Traffic Rules (Traf. R. 8).  The purpose of the arraignment is to assure that the accused is aware of the charges against him or her, and that the accused is made aware of his or her rights. (Traf. Forced Blood Draws…in America?

Image via WikipediaOhio Revised Code Section 4511.191(A)(5) allows forced blood draws.  Officers may use "whatever reasonable means are necessary to ensure that the person submits to a chemical test of the person's whole blood or blood serum or plasma."  This section applies to persons who have two prior convictions.  O.R.C. 1547.111(B) applies the "whatever means necessary" test to watercraft.Ohio Revised Code 4511.191(A)(4) authorizes the State to withdraw blood from a corpse or from a person who is unconscious or from a person who is incapable of withholding consent.Ohio Revised Code 4511.19(D)(1)(b) provides that courts may admit blood evidence upon...

Dayton Sobriety Checkpoint is a Bust

Image via WikipediaThe sobriety checkpoint Friday, Oct. 30 on North Dixie Drive produced only three arrests for operating a vehicle while intoxicated.  Other citations included nine charges for driving under suspension or without a license, and 21 other violations, including traffic, seat belt and child restraint issues.The checkpoint was set up from 8 p.m. to midnight Friday by the Montgomery County Sheriff’s Office, the Ohio State Highway Patrol and the Montgomery County Combined Agency O.V.I.
