Judges Express Concerns Over Ignition Interlock Implementation

As Ohio is contemplating "Annie's Law" which would require Ignition Interlock Devices for every first-time OVI offender, it is important to look at how implementation went in other states.  The National Highway Traffic Safety Administration recently released a report on Arizona's adoption of the law. The Ohio “Clear and Convincing Evidence” Standard

Clear and Convincing Evidence is required for the standardized field sobriety tests to be admitted. Ohio Revised Code 4511.19(D)(4)(b) sets forth the standards for admissibility of the results of field sobriety tests in OVI (drunk driving) prosecutions.  See State v. Bozcar, 113 Ohio St. 3d 148, 2007-Ohio-1251, 863 N.E.2d 115 (2007).  In order for the tests to be admissible, the State must demonstrate:By clear and convincing evidence. The Officer administered the tests in substantial compliance. The testing standards for any reliable, credible, and generally accepted test. Miami Township OVI Checkpoint (August 23, 2013)

If you live in Miami Township, be prepared for a Miami Township OVI checkpoint.  The Montgomery County OVI Task Force announced today that a Miami Township OVI checkpoint will be held in the area of Ohio 741 (Springboro Pike) between Alex Bell and Ohio 725 (Miamisburg-Centerville Rd.) beginning at 7 p.m.  In addition to the Miami Township OVI checkpoint, the Clark County OVI Task Force has announced that they will be conducting over 1000 hours of aggressive saturation patrols in and around Springfield, Ohio throughout the Labor Day holiday. Ohio DUI Crackdown Begins Friday

The Ohio State Highway Patrol has announced that their "Drive Sober or Get Pulled Over" Ohio DUI crackdown will begin Friday, August 16 and last through Labor Day.  During the enforcement period, Ohio DUI law enforcement partners have planned more than 7,000 enforcement hours and more than 900 hours of DUI saturation patrols around Ohio. “Law enforcement partners across the state will be out in full force to ensure people are making the right decisions on our roads,” said Ohio Department of Public Safety Director John Born. “Impaired driving is a serious matter, and the message is clear – drive sober or...
