OVI Defenses For Fat People

OVI Defenses for FAT People Did you know that the DUI laws are inherently biased against most of us? Alcohol loves water and will move into spaces where water is the most prevalent.  Fatty portions of the body have a low water content.  They absorb little of the alcohol. While muscular portions of the body have a high water content and absorb much alcohol.  As it is carried to all parts of the body by the blood, the alcohol distributes itself in proportion to the water content of the various parts of the body.  It is the presumed relationship between the amount of...

First Offense OVI

In First Offense OVI Ohio defines a first offense OVI at O.R.C. 4511.19, as a DUI with no priors within ten (10) years.  A first offense OVI is charged in three ways.  The first charge is caused by testing over the legal limit of .08% B.A.C. Your Right To Drive Is A Fundamental Freedom Not A Privilege

Your Right To Drive! Have you ever been told that “driving is a privilege?” Bah! This author argues that case law needs to be expanded to include “driving” as a fundamental right. This right exists under the First Amendment’s Freedom of Assembly. Thus, the analysis should be under the substantive due process analysis not simply under the procedural due process analysis. You cannot take your right to drive without due process of law. Your Right To Drive Is Fundamental Because the human rights of freedom of movement, right to earn a living and the right to peaceably assemble are only capable of being...

Underage Drinking In Ohio

Underage Drinking in Ohio Underage drinking (possession or consumption of beer or intoxicants) is a serious crime in Ohio. Firstly, the charges are first-degree misdemeanors carrying a maximum penalty of 180 days in jail and up to a $1,000.00 fine. In addition, a conviction may leave you with a “criminal record” which is much more serious than a fine or costs. Fear, shame or guilt may compel you to want to plead guilty to put the charge behind you, but that decision may have long-lasting and unintended consequences. If you are under 21 years old, drinking alcohol is illegal in the State of...
