Are You The Best DUI Attorney? Here Is My CV…

Are You The Best DUI Attorney? Someone called my office the other day and demanded an answer. "I want the best DUI attorney, Is that you?" Believe it or not, I have encountered this question a few times. I always answer by saying, "I have experience, credentials and a great track record, but you should sit down with me and see if I'm right for you."  The truth is that you have to choose an attorney who is qualified.  Once they pass that test, you have to judge them on a more intuitive level. Do you like them? Has their staff...

Reviewed & Experienced DUI Attorney

Defense of an Ohio DUI or alcohol-related charge can be challenging. The main witnesses against you are the police. There is scientific evidence from the breath test, blood test or urine test that is presented against you.  Ohio has set strict limits on the ways the chemical tests can be attacked.  Your attorney will need to be familiar with the defenses and be skilled enough to present those to a judge or jury.  Often, a video tape of the arrest will be bolstered by the police officer's testimony.  Your performance on the standardized field sobriety tests may be damaging to...

Speed Camera Scams Still A Thing In Ohio

If you think that Senate Bill 342 banned all speed cameras, you must not have driven through Newburgh Heights. Tucked over off I-77, Newburgh Heights has continued issuing tickets with hand-held devices that don't require officers to pull anyone over to issue a citation. To supplement their budget, they are churning out tickets at the tune of 300 per week. Plenty of folks aren't happy about it but Newburgh Heights doesn't care.  Another Ohio city, Linndale, has built essentially a house with all the comforts of home — so that it can reap the benefits of traffic cameras while some Linndale...

This Constitution Day, Let’s Restore Faith In The Criminal Justice System

The criminal law is precariously balanced between protecting our safety and preserving our freedoms. Good lawyers and good police officers work as adversaries, but in concert, to advocate for the system to be the best it can be. The current climate of "us versus them" is too prevalent in the system and has the potential for disastrous societal ramifications. Policy-makers have imposed agenda driven outside influences on the criminal justice system that make balance hard, if not impossible. When this happens we have decade long imbalance that results in citizens distrusting the system. The "War on Drugs" and Prohibition are examples...

What If The Prosecutor Won’t File Charges? O.R.C. 2935.09

In a story that is breaking today, family members of Tamir Rice are seeking to skirt local prosecutors and ask a judge to issue warrants for murder against the police officers involved in the case.  The lawyers, tired of waiting for prosecutors to take action, are relying on a rarely used Ohio law to expedite their effort to have two officers charged. The cited statute — Ohio Revised Code 2935.09 — allows anyone with information about illegal activity to file an affidavit for an official to review. It was established in 1960 to give private citizens an avenue when they feel police are...
