Dayton’s DUI Task Force Announces “Drive Sober or Get Pulled Over”

Today the Combined Agency OVI Task Force for Montgomery County announced that it will participate in a major law enforcement initiative call "Drive Sober or Get Pulled Over."  The nationwide effort will operate from August 19 to September 5th and will join forces of over 10,000 law enforcement agencies.  The press release says that over 500 extra patrol hours have been allocated and at least two OVI checkpoints have been scheduled.  Like other campaigns, this effort will be supported by a media blitz in an effort to maximize the deterrent impact.  For more on the campaign visit the High Visibility...

Intoxilyzer 8000 Finding Opposition Throughout Ohio and Beyond

In an article in the Athens News (click HERE), the newspaper outlines the latest developments in the attacks on the implementation of the Intoxilyzer 8000 breath test machine.  Apparently, the Ohio Department of Health is not providing a rousing defense of the machine.  Quoting from the article, "Toy noted that in both the Athens and Pickaway County cases, ODH official Mary Martin testified on behalf of the agency, but that Dumm's ruling says her testimony given that she has no scientific background isn't sufficient basis to validate the Intoxilyzer's findings as trial evidence." The Ohio State Highway Patrol has announced plans for a DUI sobriety checkpoint tonight in Greene County.  The checkpoint will be held at Col. Juvenile DUI in Ohio and the Learner’s Permit

My 15 year-old was caught drinking. How will this affect her ability to get her license? Ohio has adopted a very low alcohol level for persons under 21.  R.C. 4511.19(B) sets the BAC level at .02 percent but less than .08 percent (by weight of alcohol by whole blood or breath, or with an equivalent amount by blood serum or plasma or urine).  These quasi-zero tolerance levels are justified by the fact that this age group accounts for a "disproportionate share of alcohol-related accidents."
