Ohio Death Penalty: The Time Has Come

"An Ohio Supreme Court justice who helped write the state's death penalty law three decades ago and has more recently questioned its interpretation called Tuesday for an end to capital punishment in the state." (SOURCE)Justice Paul Pfeifer, the judge some call the father of Ohio's death penalty, has come out against the State's imposition of death.  He goes on to call for Ohio governors to commute the sentence of those currently on death row to that of life without the possibility of parole. Ohio has 157 men and one woman on death row. Of those, 43 were...

Dayton DUI Lawyer’s Creed; fight for the system

Our values suggest that when the government accuses you of a crime you have the right (and your attorney the duty) to challenge the evidence against you.  If attorneys vigorously fight your case, the police are trained to do a better job investigating and prosecuting crimes.  Judges who hold the state to a higher standard and prosecutors who properly exercise discretion, protect the citizens from tyranny.  Being pro-law enforcement should not ever mean we give police a pass, but that we hold them to such a standard that even in the most difficult case we trust the system.  This was...

Junk Science in Ohio DUI/OVI Cases

[caption id="attachment_26" align="alignleft" width="150" caption="Intoxilyzer 8000"][/caption]When you hear a DUI/OVI attorney decrying "junk science" that is used in court, they are most likely referring to the fact that the air blown into the breath test machine for purposes of testing cannot be the same air that is exchanged with the deep lung alveolar sacs. It is impossible to limit the breath test to limit itself to deep lung alveolar air. The theory breaks down because: IF THE MAJORITY OF AIR BEING MEASURED HAS NOTHING TO DO WITH THE BLOOD EXCHANGE THEN THE TEST IS NOT MEASURING THE AMOUNT...
