I Did Not Refuse!

If you were tested on an Intoxilyzer 5000 breath test machine, the source-code (software inside the machine) may have been rigged against you.  One of the most dramatic happenings in the science of a DUI has been the developments of the source-code battle taking place in Minnesota.  Ohio has recently rejected the Ohio-made BAC DataMaster in favor of the Intoxilyzer breath test machine (often referred to as the Intoxi-LIAR) so we can soon expect similar science-based battles in the Buckey State.Chuck Ramsay, a DWI attorney in Minnesota has been litigating the reliability of the Intoxilyzer 5000 for several years.  Recently...

Ohio Breath Test Law; the 3-hour Rule

Substantial Compliance Requires Collection Within Three Hours. R.C. 4511.19(D) sets forth a three-hour time limitation for the collection of bodily substances for alcohol and/or drug testing.  This rule is a change from Ohio's previous law which gave the State only two hours in which to obtain a sample. The time requirement has been adopted by the Ohio Supreme Court in Cincinnati v. Sand, 43 Ohio St.2d 79, 330 N.E.2d 908 (1975) and more definitively at Newark v. Lucas, 40 Ohio St.3d 100, 532 N.E.2d 130 (1988),  where the court held that tests in test cases (cases involving a violation of the prohibited...

[caption id="" align="alignright" width="240" caption="Image by OregonDOT via Flickr"][/caption]By James NashTHE COLUMBUS DISPATCH In the nine months since state officials unveiled a new device hailed as a potent new weapon against drunken driving, the equipment has been used rarely and only in a few rural and suburban pockets of Ohio. A federal grant provided $7 million to buy 710 portable breath testers in December 2008 despite warnings from attorneys, local judges and some scientists that the machines were unreliable and vulnerable to legal challenges. The Intoxilyzer 8000 made its debut in Clermont County in May. Since then, the instrument has been used just 1,116...

MADD; Phohibition with a Twist of Greed!

For years the critics of MADD have been labled all manner of evil by the group for merely suggesting that they are just a money-making enterprise.  Well now, MADD is using its member's pain to sell alcohol-free drinks. (See story below)  It is now obvious that MADD is trying to profit off the pain and tragedy of a declining social ill by switching it message to an anti-alcohol campaign rather than a common-sense approach to drunk driving.  Like their neo-prohibition ancestors they want to steer you away from alcohol to their "alternative."  This...

DUI and Mental Health

[caption id="" align="alignright" width="210" caption="Image via Wikipedia"][/caption]A study posted on www.sciencedirect.com, (direct link below) raises concerns that many who go to court-ordered alcohol counseling following a DUI conviction are not have other legitimate mental health issues addressed.  As part of a larger study to investigate the impact of sanction conditions on probation outcomes, "233 patients were screened for psychiatric conditions  and compared the findings with the psychiatric conditions identified during mandatory treatment by independent treatment providers. Adjusted rates of underdiagnosis were commonly high: 97.2% of bipolar disorder cases, 67.5% of major depression cases,...
