I was proud to attend the Ohio Academy of Criminal Defense Lawyers (hereinafter OACDL) Advanced OVI Seminar last week.  The area of DUI defense is vast. It encompasses forensic science, spectroscopy, gas chromatography, standardized field sobriety tests, standardized field sobriety test studies, breath test science, trial techniques, criminal administration, criminology, traffic law, police procedure, etc… To be proficient in the field of OVI defense, it is important to constantly train. It is vital that you stay on top of all of the legal cases and legislative changes that affect OVI.

Advanced OVI Seminar Topics

We discussed the adoption of Annie’s Law and how each of the different judges are crafting their approaches. Significant changes have come to CDL drivers and how they are suspended. Spoiler alert: the legislature made it harder to defend them.  We also received much-needed encouragement to try cases and hold the government to its burden of proof.  We also received reminders of how lax the science of OVI can be.  Many speakers from outside Ohio were amazed that we have adopted a marijuana law that makes every user (even the upcoming legal medicinal users) guilty of OVI.  That’s right if you use cannabis legally in Ohio the current law will make you impaired ALL. OF. THE. TIME!

Advanced OVI Seminar Speakers

One of the best parts of the seminar is the ability to listen to wonderful speakers from other states. Mimi Coffey, Deandra Grant and Virginia Landry all gave speeches that were alternatively entertaining and informative. The work of putting on the Advanced OVI seminar falls to a committee that consisted of Tim Huey (Columbus) and Shawn Dominy (Columbus) and many I am forgetting.  The speakers are evidence of how dedicated most DUI attorneys are to their craft.
