DUI Checkpoints – Why They Exist

  DUI Checkpoints & The Supreme CourtDUI checkpoints, have been upheld by the United States Supreme Court. In the 1990 case of Michigan v. Sitz, 496 U.S. 444 (1990), the court reviewed a checkpoint scheme to detect drunk drivers. Michigan demonstrated that its checkpoint program was minimally intrusive. In addition, they relied heavily upon the fact that Michigan established and operated the DUI checkpoints pursuant to specific procedural safeguards. The Court relied heavily upon a decision of the California Supreme Court, Ingersoll v. Standardized Field Sobriety Tests One of the areas where a DUI attorney's experience is most obvious is in the cross-examination of the arresting officer on the issue of the standardized field sobriety tests.  The National Highway Traffic and Safety Administration (NHTSA) determines which tests, if any, is correlated with impairment by alcohol. Due to extensive testing, NHTSA determined that three tests were specific for alcohol intoxication: the HGN (horizontal gaze nystagmus), the walk & turn test and the one leg stand test. No Sobriety Checkpoints In Columbus

In a rare and unexpected move, there will be No Sobriety checkpoints in Columbus.  There will be no grant-funded drunk driving checkpoints in Columbus. The Columbus Division of Police has declined to accept grant funds.  According to the Columbus Dispatch, Sgt. Michael Smith told law enforcement partners, "By order of Chief Jacobs, grant funding has been declined to fund future sobriety checkpoints operations."In addition, "It is with great disappointment that I report to you that Columbus Division of Police no longer has a formal OVI task force." St. Patrick’s Day OVI Checkpoints in Montgomery County

There will be two OVI checkpoints in Montgomery County on St. Patrick's Day. The first will be from 7 p.m. until approximately 9 p.m. at 10501 Success Ln. near Austin Pike. The second is from approximately 9:30 p.m. until midnight at 790 Miamisburg-Centerville Rd. Both of these locations are in Washington Township.In addition to the OVI checkpoints, there will be an all-out police effort to detect and deter drunk drivers. Ohio OVI Blitz Continues Through Labor Day

This weekend saw local jurisdictions fully implement the annual Ohio OVI blitz known as "Drive Sober or Get Pulled Over."  The enforcement action will last until September 7, 2015 and will be accompanied by radio, television and news coverage. The efforts are funded by massive federal grants and allows local and state police forces to garner massive overtime for the troops.
