The Finger Dexterity Test

The Finger Dexterity Test, "Damn, Your Drunk Tests Are Hard." In the movie, The Man With Two Brains, Steve Martin's character is subject to ridiculous roadside sobriety tests. Some of the tests to which Ohio drivers are subjected are also suspect.  One such test is the Finger Dexterity test. The Finger Dexterity test is not a Standard Field Sobriety Test. It has not been recognized by the National Highway Traffic Safety Administration. It is arbitrary and of little value. However, this test is a favorite amongst Ohio law enforcement officers.  Try the test yourself. I have administered this test on countless individuals...

DUI Checkpoints – Why They Exist

DUI Checkpoints & The Supreme CourtDUI checkpoints, have been upheld by the United States Supreme Court. In the 1990 case of Michigan v. Sitz, 496 U.S. 444 (1990), the court reviewed a checkpoint scheme to detect drunk drivers. Michigan demonstrated that its checkpoint program was minimally intrusive. In addition, they relied heavily upon the fact that Michigan established and operated the DUI checkpoints pursuant to specific procedural safeguards. The Court relied heavily upon a decision of the California Supreme Court, Ingersoll v. Palmer, 742 P.2d 1299 (1987).  Like Sitz, the Ingersoll case placed strict procedural guidelines on the government.Sign up...

Standardized Field Sobriety Tests: “Your Drunk Tests Are Hard”

Standardized Field Sobriety Tests One of the areas where a DUI attorney's experience is most obvious is in the cross-examination of the arresting officer on the issue of the standardized field sobriety tests.  The National Highway Traffic and Safety Administration (NHTSA) determines which tests, if any, is correlated with impairment by alcohol. Due to extensive testing, NHTSA determined that three tests were specific for alcohol intoxication: the HGN (horizontal gaze nystagmus), the walk & turn test and the one leg stand test. This three-test battery are now referred to as the "standardized field sobriety tests." Why Is This Important? Because the officer is using...

Happy Halloween From All Of Us At Dayton DUI

Happy Halloween from all of us at Dayton DUI “I think if human beings had genuine courage, they'd wear their costumes every day of the year, not just on Halloween. Wouldn't life be more interesting that way? And now that I think about it, why the heck don't they? Who made the rule that everybody has to dress like sheep 364 days of the year? Think of all the people you'd meet if they were in costume every day. People would be so much easier to talk to - like talking to dogs. ” ― Douglas Coupland, The Gum Thief Beware of the...

No Sobriety Checkpoints In Columbus

In a rare and unexpected move, there will be No Sobriety checkpoints in Columbus.  There will be no grant-funded drunk driving checkpoints in Columbus. The Columbus Division of Police has declined to accept grant funds.  According to the Columbus Dispatch, Sgt. Michael Smith told law enforcement partners, "By order of Chief Jacobs, grant funding has been declined to fund future sobriety checkpoints operations."In addition, "It is with great disappointment that I report to you that Columbus Division of Police no longer has a formal OVI task force." This means that Columbus will rely upon traditional policing to target impaired drivers instead of...

Failing the Roadside Field Sobriety Tests Is Not Conclusive In this short video, available at the Dayton DUI YouTube channel, I give an important analogy about interpreting the Standardized Field Sobriety Tests given as part of most DUI arrests. Without proper context, you can be made to appear drunk and have your performance used against you. If you find yourself accused of drunk driving, contact DUI attorney Charles M. Rowland II today. ...

Ohio OVI Blitz Continues Through Labor Day

This weekend saw local jurisdictions fully implement the annual Ohio OVI blitz known as "Drive Sober or Get Pulled Over."  The enforcement action will last until September 7, 2015 and will be accompanied by radio, television and news coverage. The efforts are funded by massive federal grants and allows local and state police forces to garner massive overtime for the troops. When coupled with the "cash cow" of issuing multiple tickets (no seat belt, no insurance, driving under suspension) at checkpoints designed to catch drunk drivers we can see why, despite the massive social success of anti-drunk driving norms, your local...
