Ohio DUI Law: Crossing Jurisdictional Lines

Suppose a person sits at a bar in Richmond, Indiana listening to John Mellencamp on the juke box and drinks to a point where he exceed the .08% BAC limit in Indiana.  The person then gets in his car and drives from Richmond, Indiana into Ohio.  While in Ohio and still in excess of the .08% BAC limit he drives through Eaton, Preble County, Ohio.  Leaving Enon, the driver is noticed by a citizen who alerts the Enon Police Department and the Ohio State Highway Patrol about erratic driving and "Jack & Diane" being played very loudly in violation of...

Motorcycle DUI – NHTSA Targets Motorcyclists for DUI Enforcement

NHTSA Devotes Time And Dollars To Study Motorcycle DUIIt is summer time and the perfect time to get out on the road.  If you ride a motorcycle, you may notice that law enforcement is paying you a a lot of attention. According to the National Highway Traffic Safety Administration (NHTSA), motorcyclists involved in fatal crashes are 2.5 times more likely to have consumed alcohol than passenger vehicle drivers.  In 2007, the number of alcohol-impaired motorcyclists in fatal crashes increased by 10 percent while the number of alcohol-impaired drivers of passenger cars declined 6 percent.  (NHTSA defines “alcohol impaired” for vehicle...

Driving Under The Influence of Google Glass

Distracted driving has drawn the attention of lawmakers.  Google Glass, the new product expected to be the next "big" thing, has been targeted as making us a nation of distracted drivers.  People who have never seen, let alone used, Google Glass are prepared to ban the product and strengthen laws against distracted driving.  The Ohio State Highway Patrol puts information about distracted driving on it's website in a Distracted Driving Bulletin.They cite the following statistic: In Ohio, there were 31,231 crashes that were caused by distracted driving from 2009 to 2011.
