Ohio Drunk Driving Checkpoint Update (Nov. 12-14)

There are no checkpoints scheduled around the Miami Valley Tonight! We have checked with our usual sources and there are no reports of OVI (operating a vehicle under the influence) checkpoints this weekend.  As was announced earlier in the week, a major Holiday Enforcement Initiative was announced which will put a large number of Ohio State troopers on our streets.  This initiative is the first in a series of initiatives that are planned throughout the rest of the year.  Be safe and designate a sober driver. Ohio Holiday Enforcement Initiative

Patrol announces two-week Holiday enforcement initiative The Ohio State Highway Patrol announced statewide plans for a two-week enforcement initiative which will begin Veteran's Day and run through Thanksgiving weekend in an effort to reduce fatal and injury crashes on area roads, while also arresting impaired drivers, apprehending wanted felons and interdicting drugs and weapons.  This initiative is the first in a series of initiatives that are planned throughout the rest of the year.Troopers will work closely with local law enforcement agencies in tactical squads to strictly enforce known crash-causing violations such as failure to yield, improper passing/lane changes, unsafe speed, and...

Forced Blood Draws…in America?

Image via WikipediaOhio Revised Code Section 4511.191(A)(5) allows forced blood draws.  Officers may use "whatever reasonable means are necessary to ensure that the person submits to a chemical test of the person's whole blood or blood serum or plasma."  This section applies to persons who have two prior convictions.  O.R.C. 1547.111(B) applies the "whatever means necessary" test to watercraft.Ohio Revised Code 4511.191(A)(4) authorizes the State to withdraw blood from a corpse or from a person who is unconscious or from a person who is incapable of withholding consent.Ohio Revised Code 4511.19(D)(1)(b) provides that courts may admit blood evidence upon...

Why the HGN Test is Fraudulent

Xenia Municipal Court History (from the court’s website)

The History of Xenia Municipal Court Records indicate that a petition to the Greene County Common Pleas court for incorporation of Xenia was filed Mach 29, 1817. Sixty-six signatures are on that document.   While the village became a city in 1834, Cornelius Clark, a lawyer became its first mayor.  The City Council had its first meeting March 3, 1834 and the city was so governed by major and city council until January 2, 1918.  Xenia had been governed by the commission / city manager form of municipal government since that date, the original charter having been adopted August 30, 1917.The first municipal Judge was the...
