Forced Blood Draws…in America?

Image via WikipediaOhio Revised Code Section 4511.191(A)(5) allows forced blood draws.  Officers may use "whatever reasonable means are necessary to ensure that the person submits to a chemical test of the person's whole blood or blood serum or plasma."  This section applies to persons who have two prior convictions.  O.R.C. 1547.111(B) applies the "whatever means necessary" test to watercraft.Ohio Revised Code 4511.191(A)(4) authorizes the State to withdraw blood from a corpse or from a person who is unconscious or from a person who is incapable of withholding consent.Ohio Revised Code 4511.19(D)(1)(b) provides that courts may admit blood evidence upon...

Why the HGN Test is Fraudulent

Officers Get It Wrong 95% of the Time![caption id="" align="alignright" width="240" caption="Statue personifying "SCIENCE""][/caption]The most important scientific study of the Horizontal Gaze Nystagmus test undertaken by someone not associated with the government is J. Booker, The Horizontal Gaze Nystagmus Test: Fraudulent Science in American Courts, 44 Science and Justice 3 at 133 (July 2004).  The biggest takeaway for DUI attorneys is that the study revealed that the HGN test was improperly administered in the field 95% of the time. Sobriety checkpoint update (July 3rd)

Saturation patrols will continue throughout this weekend and multiple OVI checkpoints are scheduled in this part of Ohio.  WHIO reports that the Montgomery County Sheriff’s Office, Ohio State Patrol and the Montgomery County Combined Agency OVI Task Force will conduct an OVI/Sobriety checkpoint tonight, but neither WHIO or the Sheriff's Office know of the location as of the filing of this update (stay tuned for details).  Clark County (Springfield) Sheriff and Clark County Ohio State Highway Patrol report no OVI checkpoint, but they are putting extra units on the road to detect drunk drivers.  Sources at the Greene County Sheriff...
