Defending the Publication of DUI Checkpoint Locations
Why do you provide DUI checkpoint locations on your site?
When this site publicizes DUI checkpoints, it actually helps law enforcement deter drunk driving. Reason magazine recently weighed in with a defense of smart phone apps during the recent controversy of whether or not companies should actively exclude these apps from their customers. People who choose to download these apps are given updates about DUI checkpoints in their area. The effort gained momentum when various high-profile politicians took a stance against the apps.
MADD also came out (in full effect) against the manufacturers and providers of these DUI checkpoint apps. To arrive at this position requires a fundamental misunderstanding of why we permit DUI checkpoints in the first place. When the United State Supreme Court upheld the constitutionality of checkpoints in Michigan v. Sitz, 496 U.S. 444 (1990), one of the main reasons was the deterrent effect they would have in the general population. The Supreme Court demanded that each checkpoint be accompanied by publication, so as to accomplish this purpose. That is why some law enforcement agencies seek to aid in the development of these apps (as explained in the video). If MADD and their confederates believe that the only reason to have checkpoints is to spring a trap and arrest as many drunk drivers as possible, then they once again find themselves in an constitutionally indefensible position.
