The Vandalia Alcohol Diversion Program
The Vandalia Alcohol Diversion Program is the only remaining judicially-established alcohol diversion program in Ohio. State v. Webb, 2012-Ohio-2962. Individuals charged with a first offense OVI face a review by the city prosecutor. If the prosecutor deems the charge to be worthy of consideration for the Vandalia Alcohol Diversion Program, then the case is sent to the Vandalia Municipal Court Probation Department.
There, the offender is further screened for eligibility by the probation staff. If, after receiving a recommendation from both the prosecutor and the probation screening, the offender is required to enter a conditional plea of guilty to an OVI offense, pay a substantial diversion fee, attend and complete a 72 hour alcohol education program and not re-offend. Once these rigorous conditions are met, then the offense will be dismissed. If an offender does not successfully complete the Vandalia Alcohol Diversion Program (as clearly spelled out in the Vandalia Alcohol Diversion Program plea form), then the plea of guilty to the OVI offense is accepted by the trial court and sentence is carried out according to law.
The Vandalia Municipal Court
Vandalia Municipal Court’s jurisdiction serves approximately 83.5 square miles, which includes the Cities of Vandalia, Englewood, Clayton, Union and the Townships of Harrison and Butler, located in the Montgomery County, Ohio. The Court is located on the 2nd floor of the Justice Center at 245 James E. Bohanan Memorial Drive, Vandalia, Ohio. The Court operates Monday through Friday, 8:00 a.m. to 4:00 p.m. The honorable Cynthia M. Heck is the elected judge of the Vandalia Municipal Court and will preside over your case and presides over the Vandalia Alcohol Diversion Program.
